Terms of Service

These Terms of Service (“Terms”) govern your use of the Kikou digital business card platform at kikou.cards (“the Service”), operated by Kikou (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Kikou is a digital business card platform that lets individuals and teams create, share, and manage digital business cards. Features include public profile pages, QR codes, Apple Wallet and Google Wallet passes, scan analytics, and lead capture.
2. Accounts
- You must be at least 16 years old to create an account.
- One person per account — sharing login credentials is not permitted.
- You must provide a valid email address and verify it before your account is fully activated.
- You are responsible for maintaining the security of your account and password.
3. Free trial
New workspaces receive a 7-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial, your workspace will be paused until you subscribe.
4. Subscription & pricing
- Kikou Pro is available at $9 CAD per month, billed monthly.
- Subscriptions are processed through Stripe. By subscribing, you also agree to Stripe’s terms.
- Prices may change with 30 days’ notice. Existing subscribers will be notified by email before any price increase takes effect.
5. Cancellation & refund policy
- You may cancel your subscription at any time through the Stripe customer portal (accessible from your billing settings).
- After cancellation, your subscription remains active until the end of the current billing period. You will not be charged again.
- No prorated refunds are issued for unused time remaining in the current billing period.
- When your subscription ends, your workspace is paused: public profiles go offline, QR codes stop working, and card editing is disabled. Your data is preserved and will be restored if you resubscribe.
- If you believe you were charged in error, contact us at support@kikou.cards and we will review your case promptly.
6. Acceptable use
You agree not to:
- Use the Service for any illegal purpose or to promote illegal activities.
- Impersonate another person or misrepresent your affiliation with any person or organization.
- Upload content that is defamatory, obscene, or infringes on the intellectual property rights of others.
- Use the Service to send unsolicited messages (spam) or to harvest contact information.
- Attempt to gain unauthorized access to other accounts or systems.
- Interfere with or disrupt the Service or its infrastructure.
7. Intellectual property
You retain ownership of all content you upload to Kikou (text, images, logos). By using the Service, you grant us a limited license to display, host, and distribute your content solely for the purpose of providing the Service. We do not claim ownership of your content.
The Kikou name, logo, and platform design are our intellectual property. You may not use them without our written permission.
8. Limitation of liability
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by law, Kikou shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Termination
We may suspend or terminate your account if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users, us, or third parties. We will make reasonable efforts to notify you before or at the time of termination, except where we are legally prohibited from doing so or where immediate action is necessary to protect the Service.
10. Changes to these Terms
We may update these Terms from time to time. For material changes, we will notify you by email at least 15 days before the changes take effect. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or the Service will be resolved in the courts of the Province of Ontario.
